Article 7.400. BLOCKAGE OF RIGHT-OF-WAY  


(a)

No person, firm, corporation or other entity shall place or permit to be placed, any dirt, sand, gravel, concrete, asphalt or other material in, or upon any public rights-of-way, ditch or drain area, except as provided for in this Article. The material stated herein shall include any material that would alter, change, divert, impede, or dam any drainage ditch area. Ditches are to remain open and without culverts except as stated in subsection (b).

(b)

A property owner shall be permitted driveway and pedestrian access across a drainage ditch area, in accordance with Article 4.600 of this code.

(c)

Any person who places any material in any public rights-of-way, or drainage area, except as provided for in this Article, shall, upon conviction be guilty of a Class "C" Misdemeanor, and shall be punished by a fine as provided for in the general penalty provision found in Section 1.106 of this code.
